Privacy Agreement between the user and the provider of the Cloud monitoring service of Smart Cloud products

This Agreement explains how your personal information will be collected, used and stored, and also sets out the terms of use of monitoring by partners who have access to monitoring as purchasers of the product as distributors or installers.

1.Privacy Agreement, details, and terms of use of the service.

2.Service delivery and service communications

In accordance with applicable laws and regulations or user agreements, we may use the information we collect in the following ways. If we use your information for purposes other than the following, we will explain this to you again and ask for your consent.

  1. 1.To provide our services to you: We use your personal information to provide and support the service. As part of the provision of the services, we may send you service announcements, technical alerts, device update requests, safety alerts and urgent actions on your device to keep it safe and efficient, as well as email messages and/or notifications to alert you to situations that require urgent action from you, such as if the battery is over-discharged and the charging action imposed on the charging device is not performed, We will send you an email notifying you of the imminent need for a physical check of the system.
  2. We will also send messages related to the back-ground technical support that we offer via notification services or emails relevant only to the use of the system or its operation and maintenance.
  3. Through your e-mail we can communicate with you to get information about the service and the effective management of it, as well as to get feedback.
  4. We use the information we collect to conduct internal data analysis and research based on feature tags to provide more accurate and personalized services and content.
  5. Product development and optimization: We use the information we collect to better understand your interests and services, improve services, and develop new features and services. When our system fails, we record and analyze the information generated at the time of the system shutdown to further optimize our services.
  6. Ensure security: We will use your information for identity authentication, security precautions, fraud monitoring, storage and backup, customer security services, and other applications.
  7. Push Notifications: When you use our services, we may send you emails, text messages, news, or push notifications. You can unsubscribe by emailing us.

3.How We Process Your Personal Information

  1. By using the tracking service, companies involved in the resale of our products may have access to your monitoring system data in order to offer a faster customer service, such companies will not have access to your information such as your last name and email address, but they will have access to your system serial number directly or when you provide it to them.
  2. If you are a Smart Cloud distributor or an installer with access to the monitoring of the end customer, your access to the data of the devices purchased by you, and in the case of resale, can only be carried out if requested by the customer and the remote monitoring functions cannot be used to study/analyze/target the use of the storage system by the end customer.
  3. If you are a Smart Cloud distributor, you will not be able to use the remote monitoring system without having previously received a written request from the end user who, by providing you with the serial number of their system, will ask you for assistance.
  4. The distributor of Smart Cloud products, or the installer of the same, will be able to access the customer's monitoring system only when the customer requests it and only for the time strictly necessary to carry out the technical activity
  5. From the App you can disable partner tracking by acting on the disable partner tracking function so that from that moment only Smart Cloud will have access to the monitoring data inherent to your system, in addition to yourself
  6. Personal Information: We will not share your personal information with any other company, organization, or individual, unless:

    1. With your explicit consent: After you have provided your explicit consent, we will share your personal information with other parties.
    2. In accordance with relevant laws and regulations or mandatory government requests, we may share your personal information.
    3. Sharing with our affiliates: We may share your personal information with our affiliates. We will only share personal information that is necessary and constrained by the purposes described in this Privacy Policy. If the subsidiary wishes to change the purpose of processing personal information, they will ask for your consent again.
    4. We may share your personal information with authorized partners: For the purposes set out in this Policy, some of our services will be provided by authorized partners. We may share your personal information with our partners to provide better customer service and user experience. For example, companies that we engage to provide data analytics services may need to collect and access personal data to provide these features. In such cases, these companies must comply with our data privacy and security requirements.
  7. Transfer: We will not transfer your personal information to any company, organization, or individual, unless the following applies:

    1. a.Transfer with your explicit consent: After obtaining your explicit consent, we may transfer your personal information to other parties.
    2. b.In the process of a merger, acquisition, or bankruptcy liquidation, if the transfer of your personal information is involved, we will require the new company or organization that holds your personal information to continue to comply with this Policy; Otherwise, we will ask the company or organization to request permission from you.
  8. Public Disclosure: We will only publicly disclose your personal information in the following circumstances, such as username, avatar, etc.:

    1. With your explicit consent.
    2. When we need to disclose it according to legal requirements: We may publicly disclose your personal information in accordance with laws, legal process, litigation, or mandatory requests from government departments.

4.Information Monitoring, Storage and Security Service

  1. Information Storage Location: We will act in accordance with laws and regulations and store the personal information we collect in the relevant countries of the users.
  2. Information Storage Time: Generally, we will retain your personal information for as long as necessary to fulfill the applicable uses described in this Privacy Policy; or to comply with applicable laws and regulations. Due to the free nature of the Cloud monitoring service, we may terminate the monitoring service at any time without affecting the user and historical data may not be available or may be partial if available.
  3. Temporary interruption or loss of historical data: Interruptions in the service may occur several times during its function and this may be due to system updates or technical problems, non-historical data may be impossible to recover, the customer accepts this eventuality without this being detrimental.
  4. Permanent interruption of the service: Smart Cloud may permanently interrupt the provision of the service at any time without this constituting damage to the user, in the event of interruption of the service by Smart Cloud, compressed and non-detailed historical data may be requested by the user and Smart Cloud will send what is in its possession within 6 months of the request, Any data deficiencies may not constitute any damage to the customer or user of the service.
  5. Information Security: We use a variety of industry-standard technologies and procedures to help protect your personal information from unauthorized access, use, or disclosure. However, security risks are inherent in all information technologies. Therefore, while we make reasonable efforts to protect your personal information, we cannot guarantee its absolute security. If you believe that the security of the Services or your personal information has been compromised, please contact us immediately. In the event of an information leak or other incident involving information security, we will activate a contingency plan to prevent the spread of security incidents and notify you in the form of push notifications and announcements.

5.Your rights

In accordance with the European Union's General Data Protection Regulation (GDPR), you have the right to exercise the following rights regarding your personal information:

  1. Right of access: You can request confirmation as to whether or not personal data concerning you is being processed and, if so, obtain access to that data and related information.
  2. Right to rectification: You have the right to obtain the rectification of inaccurate personal data concerning you without undue delay.
  3. Right to erasure (right to be forgotten): You can request the erasure of personal data concerning you, provided that the grounds set out in Article 17 of the GDPR exist.
  4. Right to restriction of processing: You have the right to obtain the restriction of processing when the conditions set out in Article 18 of the GDPR are met.
  5. Right to data portability: you can receive the personal data concerning you provided to a data controller in a structured, commonly used and machine-readable format and you have the right to transmit such data to another controller without hindrance, this does not include historical data of the quantities available on the monitoring page.
  6. Right to object: you have the right to object at any time to the processing of personal data concerning you, unless the data controller demonstrates the existence of compelling legitimate reasons for proceeding with the processing.
  7. Right not to be subject to automated decision-making: You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.

To exercise these rights, you can delete your files and other data through the APP. Please note that due to technical limitations or legal requirements, we may not be able to accommodate all of your requests. We will respond to your request within a reasonable time.

6.Changes

Smart Cloud reserves the right to update this Privacy Policy at any time. Changes will be effective upon posting on the App, without notice. We encourage you to review the Policy regularly to stay informed of any changes.

After the update, if you do not agree to the new terms, you must immediately cease using our services, or you may no longer access it. If for any technical reason you are able to use the tracking without agreeing to the new terms, your continued use of the services will be deemed to be your acceptance of the changes. Smart Cloud also reserves the right to require your explicit acceptance of the amended terms in order to continue using the services.

If you do not accept the amended terms and do not access the App within 3 months, your data may be deleted.
